What is a Trademark?

A trademark is any sign that helps distinguish the products and/or services of one enterprise from those of another. Words, logos, sounds, colors, and movements can all be registered as trademarks. A registered trademark owner has the right to prevent the use of identical or confusingly similar marks within the sectors where their trademark is registered.

What is a Design?

A design refers to the aesthetic or ornamental appearance of an object. A design can be:

  • A three-dimensional feature, such as the shape of an object, or
  • Two-dimensional elements like patterns, lines, or colors.

For example, the pattern on a piece of clothing, the shape of a glass, or the user interface of a mobile application may be registered as designs, provided they are new and distinctive.

Design registration primarily protects against photographic similarity. It does not protect functionality. Therefore, design registration is essential for products where visual appeal is a primary or secondary factor in the purchasing decision. In design registration applications, parts of a product that are not visible during normal use cannot be protected.
